Code of Conduct for Compliance of labour,
minimum wage and posting laws
The contractor hereby declares to Anlagenbau Austria GmbH (hereinafter referred to as ABA) in connection with our contract for work and services that it will comply with the following provisions and, in the event of legal action by third parties, that it will fully indemnify and hold harmless.
- Compliance with minimum wage laws
- The contractor undertakes vis-à-vis ABA to comply with the respective applicable regulations on the statutory minimum wage in the country of deployment and to pay its employees who fall within the scope of minimum wage laws at least the currently applicable statutory minimum wage and to comply with all statutory requirements. In this regard, ABA reserves the right to demand current evidence such as performance records or wage statements at any time.
- In the event that subcontractors or, after these, further subcontractors are used, ABA shall be entitled to demand up-to-date evidence, such as performance records or wage statements, from these at any time.
- Wage and social security contributions
- The contractor undertakes towards ABA to comply with all statutory wage and social security obligations in due time. ABA reserves the right to demand up-to-date evidence such as proof of contributions, clearance certificates from health insurance funds and tax offices or wage statements at any time.
- Compliance with labour laws
- The contractor undertakes vis-à-vis ABA to comply with all applicable labour laws in the country of assignment. This applies in particular to applicable working time laws.
- Compliance with anti-illegal employment laws
- The Contractor undertakes to ABA to comply with all applicable illegal employment laws. This also includes compliance with all relevant statutory regulations on the employment of staff. The contractor shall take effective action against illegal employment and undeclared work.
- Compliance with posting laws
- The contractor undertakes to ABA to comply with all posting laws in the country of assignment. This applies in particular to registration requirements vis-à-vis state authorities and offices. ABA reserves the right to obtain any registration confirmations.
- In the event that residence and/or work permits are required in the country of assignment, ABA shall be entitled to obtain the current residence and work permits at any time.
- Compliance with labour supply laws
- The contractor undertakes to ABA to comply with all applicable labour supply laws.
- Other
In the event that ABA has to confirm its clients’ compliance with labour, minimum wage and posting laws, ABA reserves the right to forward this declaration of commitment as well as various proofs to the client(s) in order to maintain the subcontractor chain.
